I'm assuming too that your husband is the primary applicant for the I-485. Does your husband have his I-140 approved because if he does then I believe he can file for 3 year extension? In my opinion, it's good to have your H1 or H4 intact just in case something happens to your application. I also think that having EAD and AP also benefits you for emergency purposes. To answer your second question, yes, the employer can revoke your I-140 petition which could result in denial of I-485 application. You are only covered under AC21 if your I-485 has been pending for more than 180 days as the previous poster suggested.

The text is printed on your SSN card based on your visa status at the time of application. EAD is also a temporary status, this also requires a renewal. Hence, you would not be able to "remove" the text from your SSN card until your receive the GC.

Does the "Receipt Rule" apply if an approved EAD is lost in email and a replacement EAD is applied for. The documentation mentions that it is valid to accept the EAD receipt for upto 90 days after joining date or for 90 days after reverification(which I presume happens after the current EAD expires)

You are absolutely correct. The original poster's information indicates that no I-485 is pending, so I wasn't thinking about the AP alternative.

You need to be in valid H1B status to get H1B extension. If you have abandoned it or it has expired, then you are subject to H1B quota. But I don't have any document/memo to support it. Wait for more senior people's response.

Hi,
My parents' and 2 brothers' B2 visas got rejected yesterday. The VO didn't state the refusal reason. He didn't stamp anything on their passports. I got my GC through asylum, and will get married in Nov. 2009. I supplied a formal letter from my pastor about the wedding that it's real. And my parents stated that they are not bringing my youngest brother to the US because he has school. During the interview, the VO asked them about me. He knew that I got my GC through asylum. He asked if I work or go to school. My parents answered honestly that I'm currently working to support myself.
My parents didn't show their bank account, certificate of properties and business because the VO didn't ask for it. Should they show them to VO eventhough he didn't ask to see it?
Now, we're preparing to apply B2 visa for a second time. Here are my questions:
1. When do you think they should apply for the visas again?
2. What can I do to support the fact that they will definitely go back to their country? Should we write a letter stating the reasons why they won't immigrate to US?
3. My parents are taking care of my elderly grandfather, 80 years old. Should they state this for a reason they'll come back, and also bring his photo?
4. Will they get a better chance if they leave all of my 3 younger brothers at home?
Help...help....please...I really want them to attend my wedding.

My case is a little special:
After my wife (H-1B) filed I-140/I-485, I got EAD in Dec 2006, and I (H4)started to work by using EAD from Jan 2, 2007. On May 10, 2007, we received I-140/I485 denial letter. we filed a reopen and reconsideration for I-140 denial. I was still using that EAD for work (it is vaild from Dec 2006-Dec 2007) during that time. In November 27. 2007, I changed my visa from H4=>H1.(I was not being asked by USCIS to go aborad for re-stamping H1, anyway it is approved). The USCIS denied our Reopen and Reconsideration for I-140 again later in March 2008.
Now the comany sponsor me to apply for EB2 green card.
Usaually, when using EAD, your status is AOS, and when I-140/I485 denied,
you lose your status. In my case, from May 10-Nov 27, I maybe already lose
my status. however, H4=>H1 is OK without any problem.
My question
1.
I worried that in the future, in the stage of waiting for I-485 approval, does USCIS can find out that I have the above problem between May 10-Nov 27, (it is over 180 days)?!
--However, during that period, I have a I-140 reopen and reconsideration case pending?--does this mean legally staying in US? (even it denied again later)
2.
If this is a problem, do I had better go home country/re-entry US once to clean these mess?
3.
However, I am over 180 days, is that possible that I can not come back?

I have valid H1B from June 2007- June 2010. I have reentered the united states twice ( Aug 2008 from India, July 2009 from U.K) on advance parole with out my H1B being stamped. Now my attorney thinks I am under parolee status and my H1B cannot be renewed. However, I am under the impression that my H1B extension can be filed as I am working for the same company and when I reenter the states, I could have my H1B stamped and I will have dual status with out losing EAD, AP and pending 485 application? Can you please indicate if there is any USCIS memo which indiactes H1B can be extended with out losing parole status/ pending 485 application?

Dear all,
I just realized that my lawyer forgot to mention A# in my 485 application. I have an approved I140 and the approval notice does have A# mentioned on it.
Does any one in this forum know if I am in trouble? I have sent a copy of my I-140 approval notice in my application though.
Any thoughts/experience?
