    Yes It applies to new employer as well.

    Here is my timeline

    on h1 to US in 2001
    filed labor in 2003 approved
    Filed i 140 and i485 in 12/2003
    Changed job to another employer on 05/2005 using EAD
    got married, couldn't file for wife's GC
    Applied for h1 through new employer in 2006
    Premium processing of H1 approved in 15 days. Got wife here on H4
    approved for 3 years for using I 140
    PD current as of June 2006, filed for wife's GC who came here on H4


    EAD can be canceled anytime by USCIS if underlying petetion i 485 is rejected. Also, if you change job before 180 days and your I 140 is not approved, old employer can withdraw it. Its kind of risky to do AC21 before 180 days from i485 RD.

    I own house too. My immediate goal would be to get my PERM and I-140 approved and with the help of approved I-140 get a 3 years extension so that i can stay and enjoy my new house for few more years. By the way i was in this queue in Mar06(my first perm) and Jun 07(My second perm) and now again in April 09. I am building my patience every year :D

    Yes, I saw that you are applying for the third time, I saw in another post your 140 got approved too earlier. May I ask what screwed it up for you couple of times? You can IM me if you don't want to discuss here, just want to get some idea not complete details.

    Its not so bad. The President could have created a consensus to not to anything right now in the meeting on 17th June. He has postponed the meeting, which seems to indicate that they are trying to cut a deal or count votes required for the bill. Its not bad, its a good news.

    USCIS had issued a Direct Filing Update which stated that if the application was filed after July 30, it would have to be filed at the center which has jurisdiction over the state the applicant lives in, which in your case is Massachusetts.

    USCIS has been transfering a lot of applications between the various service centers lately due to the July fiasco. Based on reports from the Ombudsman, USCIS is trying to avoid any unnecessary rejections, and take a more 'customer service' based approach, so hopefully you will be ok, and they'll just transfer the case to the appropriate service center.

    I'm not a lawyer by any means, so please use this advice at your own discretion.

    I read now about Direct Filing....and I understood that if you apply after july 30...you can send the application either to Nebraska or Texas. Hopefully I'm right in this matter.

    Hi,

    We are filing I-140 in EB2 category in this month; I came to know from this forum that one should include 2 affidavits from past colleagues or managers with job duties if experience letters can't be obtained with job duties.

    I have two questions with regard to Experience letters -

    (i) My previous employer (worked in 2003 in India) is no longer in existence, and i could only get one affidavit from the client manager. I don't know now any other colleague from the company, so I�m not sure what can be done in these cases. Please advise...

    (ii) I have obtained two affidavits, one from a manager and other from colleague for a previous company that i worked in 2009 in US. But the job duties they agreed to sign is not 100% equal to job duties included in PERM application for that previous experience. What i meant by difference is, wording may be slightly different or of the 6 to 7 job duties, one or two may be different. This happened because my manager advised that he could only include job duties of system analyst (per H1B petition) but my actual job duties are particular to a technology.

    I'm not sure if there should be 100% match between experience letter/affidavit job duties and job duties included in PERM application for previous experiences. Please advise..

    I think my thread is very long, but i feel this will help all of us to understand the legal requirement and help us avoiding any RFEs or denials in I-140.

    i wanted to know what are the chances of a persons i40 to be denied if another with the same profile in the same team and same application is recently denied
    for your information both are masters candidates and are eb2 filed
    but his was file months before mine and he got audited
    mine is in the process of being filed

    not sure of whether this even matters and cases are indepedent
    but just wanted to know ahead of time if it calls for a sure denial

    well I wouldn't classify any company as good or bad, i've only gone to one company and have been with them since 05 and have no issues so far. They have provided me with everything that i needed and have so far been very professional.

    I'm not sure if I'm allowed to write company specific information on the forum, so I'll refrain from that. But if you like any specifics you can drop me a PM. Heres what my company offers:

    * NO Contracts / Bond what-so-ever.
    * I get to choose my own rates (if i get my own contract that is, and i have so far)
    * There is a 60:40 ratio. 60 i keep and 40 they keep. - Before taxes of course.(You might think this is high, but it's worthwhile cos i get no headaches)
    * I get PPO Blue Cross Blue Shield Medical coverage for me and my wife.
    * Upto $1000 in dental coverage in a year, reimbursed.
    * Direct contact with the lawyer and i can pay him directly any immigration related fees, or opt to take a fraction off my paycheck. (Hence i know the actual cost and i know they are not charging any overhead costs)
    * Direct deposit guaranteed at the end of the month even though they haven't received the payment as yet.
    * I can leave them when ever i want, no questions asked nothing.
    * If you are with them and you get your spouse in, they will offer up to 80:20 ratio and same benefits.

    CONS:
    ====
    * No training, in any related fields.
    * You have to find your own contract (although they have affiliations with head hunters who would help in getting u a contract)
    * Haven't ever spoken about on-bench pay... but i figure they will pay min for a month if need be.


    At first i thought the ratio was too high and was looking to switch, and at the same time my wife was getting her H1B. A company NJ offered her a ratio of 70:30 and min benefits, plus a 1 year contract of which if breached would cost us 20K.

    After she got her H1B and $2,500 in legal fees, they changed their minds, and was willing to pay only a fixed pay of 55K. I waited till she finished her training, and said screw you, gave em the finger.

    She's now working with my company, and making 97K with a 80:20 ratio. Almost 20K more than me! lol.:eek:

    In a nutshell i would watch out for the following no matter which company you choose.

    * Make sure you cover all grounds with them 1st.
    * Get everything in writing before anything. (In my case the first time it worked out fine, cos 60:40 was a high ratio but they offered all the benefits and no hassle.)
    * Make sure you have access to the lawyer directly.
    * Always go for a ratio basis, the more you are billed the more you earn, and it motivates you.

    I agree, a good "cheat" is a spray bottle of water on your belt...... makes them look way better in all sorts of conditions.

    Also if you're going to have a lot of clusters, get the angle so they merge more, and saturate the final output more to give it oomph

    My current AP expires on October 15th. So if I apply for AP renewal now, and the go out for H1B stamping in September. Lets say if for some reason my H1B doesn't get stamped/denied, and meanwhile I try to come back in USA on my current AP - Would this be a problem at POA..IO may cause problem that I don't have valid H1B and AP renewal is pending, and on the top - my current AP expires within next few weeks..

    What do you think..??

    Hey Omved,
    If I were you, I'd try getting the H1B stamp BEFORE the AP expires. So that, in the worst case (if H1B stamp gets rejected), you return on the still-valid AP. And you should be able to get visa appointments to Canada/Mexico (I haven't tried the latter) before Oct 15th - the short trip seems worth it.

    Of course, if H1B gets rejected and you haven't applied for AP renewal, then your India trip will need to be postponed...

    The other option is to take the risk, go to India and apply for H1B stamp. If that doesn't work, then wait for your AP renewal to come through (waiting in India till that happens), provided you have applied for the AP renewal BEFORE going to India.

    I honestly can't think of any other options...can you?

    No, if you had H1 before (in 6 years) you are not subject to cap.

    If you don't have 1 year gap. otherwise you are subjected to.

    It goes to the FBI database. They do an extensive backgroud check on you for upto 7 years. They go verify your background in your home country too. If you remember they would have asked you to fill up a biographic information form along with the fingerprinting.

    I have submited my FP all 10 fingers when I was working for my past employer which was a financial company dealing in Credit Cards business. They collect it when they issue badge as part of security and its a federal requirement for financial company. I am not sure if they maintain it internally or send it to FBI for storage does any one have any info?
